This HotelTonight Privacy Policy describes how HotelTonight, LLC and its affiliates (“we,” “us,” or “HotelTonight”) process personal information in relation to your use of the Service. The Service includes our mobile application (“app”) and hoteltonight.com, as well as any application program interfaces, including all associated features, tools, and services.

1. WHAT IS PERSONAL INFORMATION.
"Personal information" refers to any information which is related to, associated with, or could be reasonably linked to an identified or identifiable individual.
2. WHO CONTROLS MY PERSONAL INFORMATION.
Where this Policy mentions "HotelTonight," "we," "us," or "our," it refers to HotelTonight LLC, which is the company that is responsible for your personal information under this Privacy Policy (the "Controller").
3. PERSONAL INFORMATION WE COLLECT.
We may obtain the following categories of personal information, depending on how you interact with us.
3.1 Personal Information Needed to Use the Service.
We collect personal information about you when you use the Service. Without it, we may not be able to provide all services requested. This personal information includes:

By providing us with personal information about others, you certify that you have permission to provide that personal information to HotelTonight for the purposes described in this Privacy Policy and you have shared the HotelTonight Privacy Policy with them.
3.2.2 Support Information.
Such as call recordings and transcripts consistent with the requirements under applicable law, and messages collected to provide customer support services, including investigating and responding to user concerns and monitoring and improving our support processes.
3.2.3 Reviews.
Such as review content and the ratings you provide.
3.2.4 Other Information.
Such as when you respond to surveys, participate in research, photographs, comments, or other feedback, participate in promotions, choose to connect your HotelTonight account to your Airbnb account, or otherwise share your experience with us. We will collect any personal information, including sensitive personal information, when you voluntarily provide such personal information to us or permit us to access it through device settings you control.
3.3 Information Automatically Collected by Using the Service.
When you use the Service, we automatically collect certain personal information, including:
3.3.1 Geolocation Information.
Such as approximate or precise location, determined from your IP address or mobile or other device’s GPS, or other personal information you choose to share with us, depending on your device or browser settings. We may also collect this information when you’re not using the app if you enable this through your settings or device permissions.
3.3.2 Usage Information.
Such as your hotel searches, reservation history (including the value of your bookings for our HT Perks Loyalty Program), account history, access dates and times, the pages you’ve viewed or engaged with before or after using the Service, and other actions you take on the Service, including the pages or content you view and links you click to access third-party websites or services. We may collect this information from users who haven’t created an account or logged in.
3.3.3 Device Information.
Such as IP address, access dates and times, hardware and software information, device information, device event information, unique identifiers, and crash data. We may collect this information from users who haven’t created an account or logged in.
3.3.4 Cookies and Similar Technologies.
We use cookies and similar technologies as described in our Cookie Policy.
3.4 Personal Information We Collect from Third Parties.
We collect personal information from other sources, such as:
3.4.1 Third-Party Services.
If you choose to link, connect, or login to the Service with a third-party service, such as Apple, Google, or Airbnb, you direct that service to send us personal information, such as your name and contact information, as controlled by that service or as authorized by you via your privacy settings at that service.
3.4.2 Other Guests and People You Invite.
If a person adds you as a guest on a reservation they make, that person can submit personal information about you, such as your first and last name and your email address. If the person provides your email address for a reservation, then you may receive information about the reservation. With your permission, we can access your contacts list and you can use that information in the app to invite your contacts to the Hotel Tonight Platform.
3.4.3 Other Sources.
To the extent permitted by applicable law, we may receive additional personal information about you, such as information to help detect fraud and safety issues, from our service providers, other parties, our corporate affiliates, and/or partners, and combine it with other information we have about you. For example, we may receive fraud warnings from identity verification service providers for use in our fraud prevention and risk assessment efforts. We may receive information about you and your activities on and off the Service or about your experiences and interactions with our affiliates or partners.
4. HOW WE USE PERSONAL INFORMATION WE COLLECT.

4.5 Provide, Personalize, Measure, and Improve Our Advertising and Marketing.

5.1 With Your Consent or at Your Direction.
Where you provide consent or direct us to share your personal information, we share your personal information as described at the time of consent or choice, such as when authorizing a third-party application or website to access your HotelTonight account, publishing a review, or participating in promotional activities by HotelTonight partners or other parties.
5.2 Who We Share With.
We may share your personal information with:
5.2.1 Our Corporate Affiliates.
We may share personal information with members of our group of companies, including Airbnb, Inc., for business, operational, or safety and security reasons. We may also share your personal information in connection with promotional activities administered by HotelTonight and our corporate affiliates.
5.2.2 Hotels or Your Co-Travelers.
When you make a reservation, certain personal information, such as your name, email address, and phone number, will be shared with the hotel you reserve to assist with coordinating your stay. If you add another guest to a reservation, your full name, travel dates, hotel information, and other reservation details will be shared with that guest.
5.2.3 Our Vendors and Business Partners.
We may share personal information with vendors providing services to help us run our business and for their compliance operations, including those that help us: (i) verify your identity, (ii) perform risk and fraud assessment, (iii) perform product development, maintenance and debugging, (iv) allow the provision of our services through third-party platforms and software tools, and (v) provide customer service or advertising, and (vi) process payments. These providers are contractually bound to protect your personal information, have access to your personal information to perform these tasks, and may also disclose your personal information where required by law. We may share personal information with our business partners and other companies with whom we have formed a strategic partnership or established an integration to provide the Service.
5.3 Why We May Share Your Personal Information.
We may share your personal information in order to:
5.3.1 Comply with Law, Respond to Legal Requests, Prevent Harm, and Protect Our Rights.
As we reasonably deem appropriate, we may disclose your personal information to courts, law enforcement, governmental or public authorities, tax authorities, and/or authorized third parties, if and to the extent we are required or permitted to do so by law and where disclosure is reasonably necessary to (i) comply with our legal obligations, (ii) comply with a valid legal request, such as a subpoena or court order, or to respond to claims asserted against HotelTonight, (iii) respond to a valid legal request relating to a criminal investigation to address alleged or suspected illegal activity, or respond to or address any other activity that may expose us, you, or others to legal or regulatory liability, (iv) enforce and administer our agreements, (v) investigate potential violations of applicable law, (vi) respond to emergency situations which may involve the risk of death or serious physical harm, (vii) respond to requests for or in connection with current or prospective legal claims or legal proceedings concerning HotelTonight and/or others, in accordance with applicable law, or (viii) protect the rights, property, or personal safety of HotelTonight, its employees, its users, our hotel suppliers and vendors, affiliated companies, and/or members of the public.
Where appropriate and/or legally required, we may notify you about legal requests. We will not notify you if (i) providing notice is prohibited by the legal process itself, by court order we receive, or by applicable law, or (ii) we believe that providing notice would be futile, ineffective, create risk to anyone else, create or increase a risk of fraud upon or harm to HotelTonight or others, or expose HotelTonight to a claim of obstruction of justice.
5.3.2 Effectuate Business Transfers.
If HotelTonight undertakes or is involved in any merger, acquisition, reorganization, sale of assets, bankruptcy, or insolvency event, then we may sell, transfer, or share some or all of our assets, including your personal information, in connection with such transaction or in contemplation or negotiation of such transaction. In this event, we will notify you before your personal information is transferred and becomes subject to a different privacy policy.
5.3.3 Enable and Contextualize Reviews.
Review content (including guest photos) and the ratings you provide will be published and made publicly available, along with additional information, such as your first name, your last name initial, the date you joined HotelTonight, your perks level, the number of nights you booked through the Service, the number of countries in which you have made reservations, and the number of cities in which you have made reservations.
6. MOBILE APPLICATIONS.
When you use our app, we may use your location information to show you nearby hotels or special promotional rates. You are not required to permit us to access this information to use the app. You can control the data shared from your device to our app at any time by adjusting your device’s settings. You may uninstall the app from your device at any time to discontinue app collection of your personal information, and you may delete your account from within the app. If you have an active reservation with HotelTonight, we will not be able to delete your account until the reservation is complete.
7. THIRD-PARTY PARTNERS AND INTEGRATIONS.
Parts of the Service may link to third-party services. HotelTonight does not own or control these third-party services. When you interact with these third parties and choose to use their service, you are providing your personal information to them. Your use of these services is subject to the privacy policies of those providers, including Google Maps/Earth Additional Terms of Use, Google Privacy Policy (see here for more information on how Google uses personal information), and PayPal Privacy Statement.
8. YOUR RIGHTS AND CHOICES.
You may be able to access and update some of your personal information through your account settings. If you connect or login to the Service using a third-party service, such as Apple or Google, you can unlink from that service using that third party’s settings.

9. RETENTION.
9.1 Retention Periods.
We retain personal information for as long as needed or as permitted in light of the purpose(s) for which it was collected and lawfully further processed and consistent with applicable law. The criteria used to determine our retention periods include:

whether we have an ongoing relationship with you and provide the Service to you as well as the length of time thereafter during which we may have a legitimate need to retain your personal information, such as to manage and protect our business, address issues, or defend claims that may arise,

whether there is a legal, tax, reporting, or auditing obligation to which we are subject, such as anti-money laundering requirements, that requires us to keep records of your transactions for a certain period of time before we can delete them, and

9.2 Shared Information.
Information you have shared with others using the Service, such as reviews, may continue to be publicly visible, even after your HotelTonight account is deleted.
9.3 Residual Copies.
Because we take measures to protect data from accidental or malicious use, loss, destruction, or alteration, residual copies of your personal information may not be immediately removed from our backup systems.
10. SECURITY.
While no organization can guarantee perfect security, we are regularly implementing and updating our administrative, technical, and physical security measures to help protect your personal information from unauthorized use, loss, destruction, or alteration.
11. CHANGES TO THIS PRIVACY POLICY.
We reserve the right to modify this Privacy Policy at any time in accordance with applicable law. If we do so, we will post the revised Privacy Policy and update the “Last Updated” date at the top. If you disagree with the revised Privacy Policy, you can cancel your Account. If you do not cancel your Account before the date the revised Privacy Policy becomes effective, your continued access to or use of the Service will be subject to the revised Privacy Policy.
