HotelTonight United States Privacy Supplement

1. APPLICATION

If you reside in California, Colorado, Connecticut, Delaware, Iowa, Maryland, Minnesota, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Texas, or Virginia, or are otherwise protected by privacy laws in those jurisdictions, this HotelTonight United States Privacy Supplement applies to you and supplements the HotelTonight Privacy Policy.

2. ONLINE CONTACT INFORMATION.

You may contact us via email at privacy@hoteltonight.com. We will not discriminate against you for exercising any of your privacy rights, although some of the functionality and features available on the Service may change or no longer be available to you. Any differences in the services are related to the personal information provided.

2.1 Verification

Please note that you may need to verify your identity or provide more information about your request before further action is taken to respond to your request. As part of this process, you may be required to provide personal information, such as your name, state of residence, phone number, or email address associated with your account, and/or details from your reservation history, to confirm your identity based on details we have about you.

2.2 Authorized Agent

You may designate an authorized agent to make certain requests on your behalf. In order to designate an authorized agent to make a request on your behalf, we may require that (i) the agent provide proof that you gave the agent signed, written permission to submit the request, (ii) you verify your identity directly with us and confirm the validity of the request, and/or (iii) directly confirm with us that you provided the authorized agent permission to submit the request.

3. YOUR RIGHTS

3.1 Right to Access and Know

You may submit a request:

• to access the personal information that we have collected about you,
• for more information about our data practices,
• additional information about the categories of personal information we collect, the sources of the personal information, our purposes for processing personal information, and the types of parties we share personal information with, and
• more details about the third parties with whom we share personal information.

3.2 Right to Delete

You may submit a request to delete your personal information.

3.3 Right to Correct

You may correct some of your personal information in your HotelTonight account. Any other inaccurate personal information, you can ask us to correct using the request process.

3.4 Right to Opt Out

3.4.1 Opt Out of Personal Information Selling, Sharing, and Targeted Advertising.

We may share personal information with third parties to perform certain advertising, marketing, and analytic services, which under California and other U.S. consumer privacy laws could be characterized as “selling,” “sharing,” or “targeted advertising.” We are not data brokers and we do not put personal information on the open market. You may opt out of such processing by visiting the HotelTonight website and clicking “Your Privacy Choices.”

3.4.2 Opt-Out Signals

We strive to honor browser-enabled, opt-out preference signals, such as the Global Privacy Control, where required by applicable law. When we detect an opt-out signal, we will make reasonable efforts to honor opt outs automatically where required. Be aware that your opt-out signal will typically only apply to the browser where you have set the opt out. We do not respond to “Do Not Track” signals.

3.4.3 Opt Out of Profiling that Results in Legal or Similarly Significant Effects

We do not process personal information for profiling or automated decision-making in a way that gives rise to opt-out rights.

3.4.4 Opt Out of Processing or Limit Use of Sensitive Personal Information

Some personal information we collect may be considered sensitive personal information under applicable law, including a consumer’s precise geolocation. We do not use or disclose sensitive personal information for purposes to which the right to limit use and disclosure applies under applicable law. You can restrict our collection of precise geolocation information through your device settings as described in our Privacy Policy.

We also do not knowingly process the personal information of individuals younger than 18.

3.5 Appeal a Privacy Rights Denial

To appeal a refusal to take action on your request, please see the instructions in our response to your request or submit your appeal in writing by contacting privacy@hoteltonight.com with the subject “Appeal of Consumer Rights Request.”

4. DE-IDENTIFIED PERSONAL INFORMATION

We commit to maintain and use some personal information that we de-identify (or have received in de-identified form) in a de-identified form for business purposes and will not attempt to re-identify that personal information.

5. CALIFORNIA SHINE THE LIGHT REQUESTS

You may request and obtain from us once a year, free of charge, a list of the third parties to whom we have disclosed your personal information (if any) for their direct marketing purposes in the prior calendar year, as well as the type of personal information disclosed to those third parties.

6. NOTICE OF FINANCIAL INCENTIVES AND LOYALTY PROGRAM

HotelTonight accounts are part of the HT Perks Loyalty Program where you can earn benefits, such as credits, special offers, or coupons. In some jurisdictions, including the United States, HotelTonight users can also earn Airbnb credits for their stays when they connect their HotelTonight account to their Airbnb account. As part of the HT Perks Loyalty Program, we may process your personal information, including name, contact details, information about how you use and interact with the Service, and your transaction history, including personal information about the dates, locations, and values of your stays, to administer the program and provide you with HT Perks Loyalty Program benefits, including Airbnb credits when you link your accounts. Please be aware that if you delete your HotelTonight account or ask us to delete personal information associated with your HotelTonight account, these actions will result in the deletion of your accrued HT Perks Loyalty Program benefits. You may withdraw from the HT Perks Loyalty Program or disconnect your HotelTonight and Airbnb accounts by emailing us at help@hoteltonight.com.

The benefits we offer through the HT Perks Loyalty Program will vary depending on market conditions at the time of any offer and your use of the Service. The value of these benefits is reasonably related to the value of your personal information to us as measured by the opportunity to market to you using the personal information you provide and to better engage you with the Service.
